Franklin Co Sheriff’s Dept Protects & Serves (the Banks)

The theft of houses isn’t something usually covered by Cop Block but I wanted to give it some attention because the issue today is so rampant and because Bill Bry (the victim of the theft) is a friend.

Last month a few of us from Keene traveled 45min south to Montague, MA* (right next-door to Greenfield) to join others in helping Bill move out the rest of his furniture, welding supplies, and appliances. He had been given an eviction notice, to be “served” by employees of the Franklin County Sheriff’s Department, based on what Bill considers a fraudulent mortgage issue related to the robo signature controversy.

For over four years Bill, assisted by friend Jeanne Golrick, had successfully won in court (aka mounted an effective defense) to keep his house. He views this latest theft as temporary. His words, written in chalk on a scrap piece of metal on the side of his welding building sums it up: “We are out! At this time.”

About Pete Eyre

Pete Eyre self-describes as a voluntaryist and hails from the Midwest. He went to undergrad and grad school for law enforcement, ultimately concluding that he could have a bigger impact through other avenues. In addition to being active with Cop Block, he's interned at the Cato Institute, been a Koch Fellow placed at the Drug Policy Alliance, Directer of Campus Outreach at the Institute for Humane Studies, Crasher-in-Chief at Bureaucrash, a contractor for the Future of Freedom Foundation and co-founder of the Motorhome Diaries and Liberty On Tour.

  1. TJIC says:

The first scanned document says that the mortgage holder didn’t make interest payments.

Does the mortgage holder agree with that?

Whether we’ve got a State or not, people should have the right to sign contracts…and they should have the right to create and sign contracts that specify “if you don’t make payments on this loan, the lender may take the property”.

Do you disagree that people should have that right?

If you agree that folks should be able to sign contracts, do you disagree that either party may enforce agreed-upon terms on the contract?

Now, I might prefer anarchotopia where laws are enforced by David Friedman-esque private law providers…but under either the State or under anarchotopia, people are going to sign contracts, people are occasionally going to default on those contracts, and property is going to be repossessed.

What, specifically, in this story represents wrong doing?

  2. Dan says:

It’s called “not paying the mortgage” they defaulted on the loan, where is the problem?

  3. Guy says:

The loan was fraudulent from the get-go. Banks do not loan “money”, as there is none. The whole banking system is a scam.

  4. t. says:

I fail to see the problem. Pete do you not wish for a ‘voluntary society’ where everything is done through mutual consent and civil contract?

Or does that BS just apply to other people, and not your friends?

Next time, less dope buying and more bill paying would help.

  5. Anonymous Coward says:

The problem with property taxes is that they are theft plain and simple. It is legalized government theft. You never actually own your property in America. You can’t, as long as you own said property you MUST ALWAYS pay property taxes. It doesn’t matter if you otherwise own and have fully paid for the property.

Now, one can argue about being evicted for not paying the bill of what you own, like a reposession with a car. But property tax is a different ballgame. You are in perpetual slavery by the government. You can NEVER own your own property. And the taxes are always outrageous anyway. And it doesn’t matter what your financial situation is. If I bought a T.V. it is mine forever, after I pay for it. But with property, you could have your family live on the land for a thousand years and NEVER EVER pay enough to stop property taxes. You NEVER own your land property in America.

Now this issue, I don’t know about. If it is a fraudulent mortgage , then he should stay. But you can’t have people buy a house, not pay for it, and then keep it. How is that not theft? What would be the point of buying and selling houses then? You never have to pay for them. Property taxes are one thing, but paying the bill for a house is another. I don’t like the banks. But shouldn’t honest people pay their bills? Not taxes, but bills.

So in short, property taxes bad. A mortgage or bills, it depends.

  6. Dan says:

I don’t like property taxes either but I like paved roads, street lights, snow removal from roads,,,ECT…

Under a ‘voluntary society’ I believe that there would be too many lazy people to achieve these goals.

Whenever I raise the point that Dirty Pigs (a.k.a. police) and Hosers (a.k.a. firefighters) receive obscene salaries, benefits, and pensions, a Dirty Pig, Hoser, or some yahoo always says “well, who you gonna call to come save you?”

I’m going to call the Dirty Pigs or Hosers to “save me” because I am forced, against my will, to pay taxes that pay for the Dirty Pigs’ and Hosers’ obscene salaries, benefits, and pensions.
Because I am forced, against my will, to pay for the service, I’ll use the service.

I do NOT have the right to choose not to pay taxes and, thus, not to pay for the Dirty Pigs’ and Hosers’ obscene salaries, benefits, and pensions.

    [2]

Whenever I raise the point that Dirty Pigs (a.k.a. police) and Hosers (a.k.a. firefighters) receive obscene salaries, benefits, and pensions, a Dirty Pig, Hoser, or some yahoo always says “well, look how much professional athletes and other entertainers are paid!”

I have the right to choose not to buy tickets, clothing, etc. sold by professional sports teams or other entertainment companies and, thus, not to pay for professional athletes’ and/or entertainers’ salaries, benefits, and pensions.

Again, I do NOT have the right to choose not to pay taxes and, thus, not to pay for the Dirty Pigs’ and Hosers’ obscene salaries, benefits, and pensions.

    [3]

Police and fire services are a monopoly that the Dirty Pigs and Hosers have ruthlessly exploited to the detriment of hardworking taxpayers. Dirty Pigs and Hosers do NOT need to compete in the marketplace to attract and retain customers (i.e. taxpayers). Worse, customers (i.e. taxpayers) are unable to “shop around” for a better price and/or better service.

“Since monopolies are the only provider, they can set pretty much any price they choose, regardless of demand, because they know the consumer has no choice. They can also supply inferior products. They are also bad for an economy because the manufacturer has no incentive to innovate, and provide “new and improved” products.” (By Kimberly Amadeo; About.com; source: http://useconomy.about.com/od/glossary/g/monopoly.htm)

  8. Anonymous Coward says:

What gives the government the right to take property taxes? What gives the government the moral right to take your property which you payed for if you don’t pay these taxes? It’s the same as the income tax. Your money or property is stolen from you without your consent. If you resist you get jailed, or beaten, or perhaps killed. Why should a person pay a lifelong rent to stay on their own land? Why should a person work and give half their paycheck over to the government? A government that doesn’t even use funds properly. There is no moral authority there for the government to do such a thing. And most of the time government services suck anyway.

Didn’t we fight a revolutionary war in part because of this crap? The sugar act, the stamp act, and other taxes. Tax Tax Tax.

People might actually have some money if they didn’t have to pay property taxes and income taxes to the overlords.

  9. Guy says:

@ACoward, one can never “pay” for anything. There is NO money. Study and learn “Modern Money Mechanics”, a Fed publication. All bank loans are fraudulent.

  10. Amigajoe says:

Honestly I try to keep an open mind about these issues. I know there is rampant fraud and corruption throughout the System. But you guys just sound like loons, you REALLY do.

  11. Glenn says:

This is exactly, precisely the kind of public interaction responsible citizens need to engage in.

Regardless of what tyrant is in D.C. or dictator at the state governors office, the “foot soldiers” of the Fascist machine are police and all law enforcement. Anything with a badge is a potential Nazi, and should be understood as such.

By raising public awareness of the rampant crimes committed by police forces, and letting the police know that we are watching them, very closely in this case, we can move towards restoring liberty.

  12. paschn says:

    Sigh,

Do any of you ever wonder why we never hear about this crap in the “lame stream media”? Who are they protecting?

The most dangerous people in America are Dirty Pigs who either:
    [1] receive a risk-free government pension (either as a retiree or a double-dipper) OR
[2] will soon receive a risk-free government pension (i.e. approaching date when pension payments will begin).

There are two deterrents to crime:

Deterrent #1: Adverse effect on employment. It is nearly impossible to find a job if you have a criminal record.

Deterrent #2: Dangers of incarceration in general population (e.g. battery, rape, extortion, etc.)

Neither of the two deterrents to crime is effective against “the most dangerous people in America” (see above).

Deterrent #1 is not effective against “the most dangerous people in America” (see above) because they either have risk-free income for life or will soon have risk-free income for life.

Deterrent #2 is not effective against “the most dangerous people in America” (see above) because, if incarcerated, they are incarcerated in protective custody. Thus, they are not at risk of the dangers of incarceration in general population (e.g. battery, rape, extortion, etc.).

Consequently, “the most dangerous people in America” (see above) are not deterred from committing crime and they know this fact, which is why they are “the most dangerous people in America” (see above).

[FYI: In many states, a Dirty Pig does not lose their pension if they are convicted of a crime even if the crime is related to their law enforcement duties. Thus, while the Dirty Pig is chillin' in protective custody, the Dirty Pig is accumulating all of their pension payments in a bank account and we the sucker taxpayers are paying for the Dirty Pig's housing, food, medical care, and dental care. Upon release, the Dirty Pig has a stockpile of accumulated pension payments sitting in a bank account ready for the Dirty Pig to spend on a lavish "just got out of jail" spending spree.]

    @ Clair Voyance

I find it humorous that you can “CLAIM” we get a risk free pension. We risk our lives everyday. By CHOICE. and based on the FACT that not all LEO’s are corrupt the Pension is granted AFTER “X” amount of years of service.

If a LEO is convicted of a Crime and sentenced to prison time the Pension goes away and doesnt accrue while incarcerated. If you havent completeled your term of your service you dont get your pension. I know LEO’s that served their communities with honor and were Robbed of their pensions because of cut backs or forfeited their pensions because they had to leave for illnesses that werent job related.

Show me a statute or policy that states that all LEO’s sent to prison MUST be housed in Protective Custody.

Show me where IN ANY STATE a LEO is convicted and accrues his/her pension payments while incarcerated.

you assume that ALL LEO’s are corrupt and dedicated to doing the bidding of ALL federal politicians and it’s your right to assume that. Ignorance isnt against the law otherwise every citizen in this country would be “Chillin in Protective Custody”.

    Kudos to you! It’s obvious the truth of a matter is important to you. You others ever hear of “Fractionalized banking? Fiat currency and what it means to the economy? Are you aware that banks connected to the illegal FedRes have been out-right STEALING homes fully paid for? Did you know their theft is sanctioned in many states by the “justice system”? Are you aware that the IRS is a private collection agency for the private Federal Reserve? Ever hear of the GRACE COMMISSION? SANTA CLARA COUNTY vs Southern Pacific R.R.? How about Jekyll Island? If you would really like to know the truth behind the Fascist States of America’s un-lubricated sodomizing of “we the people”;

    http://www.themoneymasters.com/

Mark it in your favs, devote a few hours to absorbing it, possibly buy the video, as I did, you’ll learn what Guy and a few others have. You’ll learn why even reverting back to the Ft. Knox gold standard, (there no longer IS any of our gold there), isn’t a good idea. Better than what they’re enslaving us with now, but not the safest as it allows the same coterie of swine the ability to screw us again by virtue of it being easy to control, (by them).

By the way, the annual $ amount of the theft through illegal taxation was nearly a TRILLION a year back in the early eighties…I leave it up to you to estimate how much a handful of private bankers, (protected by the cops), steal from our wages each year now.

If the truth is important to you, best visit these sites soon, if SOPA becomes law, these sites will become extinct, (like many of us), very quickly.

My Bad. I am adult enough to admit when I am wrong and obviously I am.
I have always been told that cops forfeited Pension payments if convicted of a crime that sent them to prison. infact it’s stated in my contract that if convicted of a felony I cannot BY LAW receive pension payments.

  21. PSOSGT says:

I guess I missed it.. this is the end of a long court civil process where the Sheriff’s department was given a court order to seize the property.

And I don’t get the point to bother the cops who most likely don’t like this part of thier job. I know I wouldn’t.. But if you sign a loan, your supposed to pay it. If you don’t. you lose “your” house, “your” car, or what ever you got the loan on.

The title to my house is in MY name, and mine alone. Just as my truck is. And the bank holds a lein against my house. And used to against my truck until I paid it off.

6 minute video tells very very little as to the months that lead up to this point. And personally, if I had been that Sheriff and I told you to stay off the property, I most likely would’ve arrested the dork who ran up and took the chair. And I would’ve seized your nice camera as evidence to the crime. And then most likely you for resisting and yelling out your rights to film me.

  22. Bill Bry says:

When a bank forges documents because they have no claim on the place, because the deal was set up as a fraud to begin with to trade on the derivatives market, and they get caught in the fraud that is national story, they should win the place anyways? Or should the homeowner, who discovers the fraud against property law since 1641, get the contract fraudsters punished by the well standing triple damages award for contract fraud? When the Sheriff has been shown the contract fraud, because it is BIG news being investigated by AG Martha Coakley and South Essex Registry of Deeds, should they be a check and balance in the system like skool teaches, or just hide their name tags and threaten force to remove the people and give it to fraudsters? I won the house in court, I proved beyond a shadow of a doubt the bank didn’t own it, I proved the fraud that should have come with clean title and triple damages to me!! Ibanez, Balivequa and Baily cases and many others across the nation have won in less-criminal courts with the same facts as this case. Also, Secret police is a North Korea tactic, not legal in the USA, only people up to no good hide their names.. I still am the only tile holder in due course by law, so no one can get title insurance on it even if they could get financing, which will be hard with no title.

  23. Bill Bry says:

If I hold paperwork submitted by the banks/globalists on the court record, that are a complete fraud, do I hold the scammers accountable in a higher court? Do I just walk away and allow the crime? Do I allow my son to pay for the house (bank bailout at gunpoint) in his future wage deductions and not live there? Do I use the law to get back at the globalists who not only did this mortgage scam, but also off shored American industry and main street mom and pop stores that was a major part of my economy here as a welder? When the media is pushing and pushing that a recovery is underway, only to see that propaganda was a big lie too; do I roll over and take it? Do I join the biggest gang in town with paychecks guaranteed at gunpoint and be a cop or government worker? People have to get off the fence, you are either with the globalists, or with We The People.

  24. Gopher Snake,

    Great!

Your contract allows you to commit misdemeanors and still collect your pension!

Also, your contract allows you to commit felonies plea bargained down to misdemeanors and still collect your pension!

I hope you don’t work near me.

  25. VYPER says:

    @ Clair Voyance

I never said that. The contract stipulates many things most of which I dont necessarily understand. I was pointing out the pertinent part that pertained to your post. I assume that based on your posting you have never committed a crime of any nature whether victimless or not, misdemeanor/felony. For that I bow humbly at your judgemental feet. In all my years as a LEO I never (until now) have met a human being that is over the age of majority that has never broken any laws. never sped, never made a threat, or any of the countless laws that are currently on the books. My how it must be lonely up there on your throne of total innocence with nobody to talk to that you don’t have to look down to see.

  26. Gopher Snake,

How can you enforce complex criminal laws if you can’t understand the simple contract laws applicable to your employment contract?

Have you ever heard the maxim “don’t sign something that you don’t understand?”

Why did you sign a contract that you don’t understand?

Do you have a habit of making decisions when you do not understand the applicable facts and laws? If so, I’m sure there are many criminal defense attorneys who would love to cross-examine you!

P.S. you misspelled “judgmental,” which makes you a Dirty and DUMB Pig.

  27. Guy says:

@PSOSGT: You do not own your automobile, if you have only a “certificate of title”. Who owns it? The STATE, as the STATE has possession of the MSO/MCO (the birth certificate of the auto). You volunteered to give it up and register the auto. Do you pay property taxes on your house? If so, you don’t own it. Study and learn.

  28. Guy says:

BTW, all police departments, sheriff’s office, courts, etc., so-called “public entities” are private companies. Check any of them out on mantadotcom. Each are traded on Dun & Bradstreet. LEO’s have no lawfull authority to engage in any of the activities they are involved in. Two seperate judgements have been recently handed down covering this. Check out rodclassdotcom for details and paperwork. Also check out title 49USC and 49CFR for specifics on who has actual authority to enforce “traffic” regulations. Hint…it ain’t the local yokels. All traffic regs fall under 49USC and 49CFR.

  29. Bill Bry says:

Yes Guy, all LEO’s are armed security guards for the state. That is why LEOs are most unlawful in everything they do. obviously Franklin County MA is under occupation by the globalists bankster criminals, as the law means SHIT here. I proved beyond a shadow of a doubt I owned my house as a result of bank/state/LEO fraud. Martha Coakley Ron Paul and a few hundred “in the system” resisters are the exception.

  30. joe blow says:

Joe Blow, take some time to read the founders quotes on how bad government is and always has been, then you will be able to make an informed comment. Thanks.

  32. Gopher Snake,

Did a mongoose bite your tongue? hahahahahaha

  33. VYPER says:

    @ Claire Voyance

didnt see your response. The things in the contract that I dont understand are pertaining to grievances and disputes. it’s not that I dont understand what it means, I just dont understand why it’s in there. Thanks for the spell check your highness, I do better next time. I welcome all defense counsel to cross-examine me. If I haven’t done anything wrong then nothing to fear.

  34. t. says:

Again, slow down on the dope, and just pay the bill. Ends the problem. Dumb asses

  35. Guy says:

@t, there is no “bill”. How can there be a bill when we have no money. Do some research and pull foot from mouth.
