Sniffer Dog Case to Hit Supreme Court

Here’s another shred of the Fourth Amendment we stand poised to lose. Sniffer dogs are not magical, they can be triggered by conscious or unconscious cues from their handler as any other dog will.

Such dogs are routinely used at VIPR, DUI, and ICE checkpoints to justify and extend searches beyond the legal scope allowed to a random stop. This may be done at the will of the handler absent probable cause.

An interesting question is why has the Federal Government chosen not to respect the State Supreme Court’s decision?

    Our K-9 followed a 6 hour old track of a 14 year old girl. Took us 3 hours to find her, but the dog brought us right to where she was at. I think that’s pretty fucking amazing. People might have thier objections about dope/drug war, and dope dogs, but these dogs ARE really good at what they do.

    Mack, Be reasonable. PSO merely pointed out that the dogs are good at finding lost little children. Even your own article says that’s the case. As far as using dogs in the drug war, well, the drug war can’t get any more ridiculous than it already is.

    Mack, what’s a “false alert”? My understanding is that it’s when a dog alerts, and there’s “nothing” there. Most common “false alert” we get is on a driver or passenger seat. There’s nothing there…cause we find the drugs stuff in the suspects pants.. The odor from the dope seeps into the seat, causing the alert.

    I can(cause we’ve done it) hold some marijuana in my hand, then walk arround the station and touch things.. Our dog will “hit” on what ever I touch. is that a “false alert” or are dog’s that good that they can detect that odor from 2nd hand contact?

    I saw an article awhile ago about the large % of dollar bills that had coke residue on them. Drug use is common so drug traces are common. What it boils down to is blanket coverage for unwarranted searches; chances are a drug dog will hit on something regardless. How convenient for the cops!

    And isn’t that what it’s all about, and to hell with our ‘rights’. In every one of these SC cases, the SC has consistently come down on the side of the State and police, and not on the side of protecting our rights. Now the infallibility of damn DOGS will be enshrined as the highest law of the land.

    But hey, it can’t happen here, right?

    psogt, why is it that cops may poses marijuana to use in their operatioins, expeirement, training and what you may call it. but citizens may not for their own reasons. seems like the same thing just different reasons.

    Casey. because the law states that we can. We also have to account for every gram.

    The law states that people with a federal firearms license can have a full auto weapon.. I can’t. There are laws, and exceptions to laws.

    @ MacK, thanks for that website info, Some years back, at the Minneapolis airport,a sign was posted that read,”Dont even joke about having a bomb” (may not be exact wording,but you get the idea) Well some dumbass did,The cops were called,the guy was detained,the cops brought the bomb sniffing dogs to his car,the dog sniffed the trunk area, and said to his handler,”I smell a bomb in there” They opened the trunk, and found a box of tide laundry soap. The cops excuse was tide soap had some of the same chemicals used in making bombs. The cops will never admit the dog was wrong. But they will change the subject,by telling you other stories about the dog finding lost children.
