Boston.com reports on January 28, a police officer’s gun went missing in Plymouth, Massachussetts after he inadvertently left it in a courthouse bathroom.
Captain John Rogers Jr. claims he put the gun down in the bathroom of Wareham District Court at about 3 p.m. January 28, then left without it. He reportedly went back for it minutes later, but it was already gone. He immediately notified court officials, who notified local police to search for the gun with the help of a weapon-sniffing dog.
The Patriot Ledger reports that court officers collected the names of everyone on the court list of appearances and also searched the parking lot, the bushes and underneath vehicles without finding the weapon.
A similar incident happened in Concord, New Hampshire on January 25. WMUR-TV had the following report:

Wichita KS police officer Officer Joseph T. McGill, 28, was convicted today of committing a sexual act on a 3-month-old child and a 1-year-old child. Officer McGill pleaded guilty in January 2012 in an unrelated case to sexual battery while on duty as a police officer and was sentenced to three years probation. Those charges stemmed from separate incidents in November 2010 and February 2011. The judge set sentencing for March 1.
So…this has what to do with double standards?

And no, I’m not condoning their actions but what does this have to do with extra rights or double standards? Nothing. This just shows the hatred for police officers that this site is really about.
If your in the Army like me this type of incident usually results in getting an involuntary discharge, and we also lose all benifits. I think the same should apply for the cop.

2/14/2010 – BAGRAM AIRFIELD, Afghanistan — An Article 15 for losing or misplacing a weapon is not required, but the majority of personnel who lose track of their weapons are receiving one. Why, you ask? Well, even though we have a few of the amenities enjoyed at home station; the truth is we are in a hostile, deployed environment. A situation may arise that will require any of us, at any time, to utilize the weapon we carry. If we become complacent and do not remain vigilant to our current environment we could pay a significant price.
Commanders at all levels are ensuring their personnel are made aware of the impact a lost weapon could have on their unit, their personnel and ultimately this operation. If a weapon was left in the restroom, at the bus stop, or in the Base Exchange, and found by someone other than another servicemember, it could be used to harm, maim or kill our servicemembers, coalition partners or the civilians who support us. You may have only left your weapon unattended for ten minutes and nothing happened, but that is all the time and opportunity the enemy needs.
Commanders have to consider the ramifications of those unplanned opportunities and take action to prevent them from occurring. On that same note, we, as Airmen, Soldiers, Sailors and Marines need to look out for each other when we can. When you see someone exiting the latrine, leaving the Base Exchange or on the bus and they do not have their weapon…ask why. If it is in their room, they are within 72 hours of departure, they are a Chaplain, or another legitimate reason exists, then no harm, no foul. If not, maybe you have helped to prevent an opportunity for the enemy to exploit.
The Air Force recognizes this year as the “The Year of the Air Force Family.” Our location demands that we recognize each other as family. We would not want to let our mother, father, sister, son, and daughters down…let’s not let each other down. Talk to each other, ask questions, help each of us serve with honor and return home safely.

I can tell you from my own 6 years of army experience that anyone, especially a comissioned officer, who lost a weapon, was sent packing. If enlisted usually an article 15 with loss of rank and forfeiture of pay, same for a non comissioned officer. If comissioned, their careers were over. The punishment was left to the commanders but there was no looking the other way. I did not see it or hear about it often, but when It did happen that person was hammered!
In fact weapons accountability is taken so seriously that upon return from Desert Storm, my unit had to wait with all the families watching for 45 minutes as the Armoury Sergeant had to account for all weapons. They had the count correct but had a couple serial numbers mixed up with the weapon but stock number that is assigned to each soldier. So until he was 100% sure all weapons were accounted for, we did not move from formation!

Once this government employee put his weapon down, he was no longer in control of it. He was “storing” it. As such he should be facing charges for violating the Massachusetts firearm storage law which w requires guns to be stored in a specific manner. All guns, when not in use, with the exception of primitive firearms, must be stored or kept “secured in a locked container or equipped with a tamper-resistant mechanical lock or other safety device,” to prevent unauthorized use. Penalties are assessed even if no underage person obtains access.

Retention, Retention, Retention. Say no more, The court security in NH is run by its own department head within the NH court system. There are no common gear requirements like a double retention holster as some have wheel guns and some have semi’s. They are not in uniform but in dress so there isn’t a duty belt as a LEO would wear. With that stated it does happen, more than some would like to know. When in civi’s and you want to pull your pants down, a 3lb piece makes it hard to do and your shouldn’t have your gun showing on the bathroom floor for other to see. I would recommend that the court officers use a secure bathroom rather than a public bathroom so they can secure their weapon without issue. Then if you leave your weapon behind its in a secure location, just a thought.
