    Come on Common. You know she had no legal authority to search that car. Once she said he was free, any further action would have been illegal and you know it. Not even under Arizona V Gant could she have done anything!! Plus, her rude and unprofessional behaviour for being asked the question that everyone should ask. She was just pissed because he knew the magic phrase. See, how cops try to rely on peoples ignorance. Once he uttered the magic phrase her attitude became combative.

    What reasonable suspicion did the officer have? There is case law on a black individual that ran from a police caravan in which the Court held that it was not reasonable suspicion to go after someone for just running at the sight of an officer. What case law is there that makes driving away when there is an officer reasonable suspicion?

    I think he handled her pretty well. He should file a complaint, though. I know a guy who was an LAPD cop. He was suspended or fired; he said it was for “cussing” at a woman. I don’t know if I believe him though. I also filed a complaint for a cop cussing at me; they seemed to take it pretty seriously. Maybe because of my history (who knows)?

    Kind of relates back to the checkpoint story where AJ Ross illegally searched/ criminally trespassed in the kid’s car. Here she openly admits to using such tactics as retaliation/ harassment, which is exactly what AJ was doing in the other video. Retaliation/ harassment for a perceived “bad attitude”. Well, she is on video admitting to her criminal tendencies, that will be her legacy.

    She’s not LAPD, you can tell by the notable lack of gunfire. She’s actually Inglewood PD.

    And I will agree, with what’s shown, it doesn’t look like there’s PC. Then again, what happened before the camera went on?

    Also, look at Parker v State, a Texas case, that cites other decisions about who, when dealing with rental cars, can and cannot give consent to search. US v Lumpkins is also interesting.

    You should check out “fourtamendment (dot) com” its a good site for decisions that come out weekly, if not daily with issue about the 4th.

    I am not concerned about the stop. In fact, I never mentioned it. I am pointing out her comment she made when he asked, “Am I free to leave”. She became clearly agitated and flat out stated she would harass him. When a cop says what she says, we all know damn well what she meant. Cops searching places knowing they can’t use what they find are doing it for one reason!

    Sorry for 2 posts but it was tea time. It would be of note to find out what happened before the camera went on. I will not say she lacked RS. The only thing that really matters is when he uttered the magic phrase and she went unhinged. There is a legal reason to ask that and cops know this. He wasn’t talking shit and like I said up above, you know that when a cop says what she says, she is making a threat to harass him by an unlawful search and she proves it would be unlawful by stating she couldn’t use what she finds!

    I am not being rude, I am just stating it wouldn’t take a Perry Mason to argue that one in court. Her own diarrhea of the mouth made his case for him!

    Ok, well if this video is true and not fake that officer is 100% in the wrong! At not time and I do mean no time is it ok to cuss at a citizen on a traffic stop…in a fight maybe, in a shooting who wouldn’t? But a traffic stop? And why because the citizen asked if he was being detained? Disgusting and she should be ashamed!
