My daughter is 23 years old. She got off of work around 10:30 PM, She got into her car and was heading home. As she came to the end of the street and took a left, she realized that the store she usually stops at was closed. She turned around in a driveway and proceeded to go right, towards the store that was open. A police officer stopped her and said that her turning around was a suspicious act..how, I don’t know. He then asked for her information and told her to step outside the vehicle. She kept asking why and he refused to answer. Because it was a male police officer, he called in for a female officer to search her. She repeatedly asked him why she was being detained. He replied, “I smell marijuana.” There is no way he smelled marijuana because she does not smoke and didn’t have any. After searching her vehicle and her, he then proceeded to take the two bottles of wine she had, which where not opened, nor had she had a drop of alcohol. He called her employer, apologizing for waking him up, and stated to her boss that if anything is missing from her job to call them in the morning. She was mortified and embarrassed. She has no criminal record. Basically, he called her boss to see if she stole the wine from her job, not knowing that her boss gave her permission to take the two bottles of wine. She is the manager of the restaurant. This can’t possibly be legal, is it? That was a major defamation of character. What could she have done? Police are very intimidating. Any advice on this situation?
