In a story called “A Traffic Ticket and a Bullet Through the Chest” Cleveland Scene Magazine’s Doug Brown uncovered a story of a Cleveland Police officer who shot a man in the chest for making an illegal right turn.

“I’m asking him if he knew he shot me. ‘Why’d you just shoot me? You just shot me!’ I was doing nothing wrong!”

Montague gets on his radio a moment later: “Shot’s fired! Shot’s fired!” he says. Other officers swarm in. Bystanders, gathering around the intersection watching the police move in, take out their cell phones and start filming. “At this time, it’s a melee,” Love explains. “It’s just cops and lights and cameras. I’m shot, it was just crazy.”

A second officer comes to the car door, stands him up and cuffs his hands behind his back. (“He told me later, ‘I’m going to have to apologize to you, but when I heard shots fired, I thought that you were the one doing the shooting,'” Love says of the second cop. “The cop that had pulled me out of the vehicle, he told me, ‘You’re lucky, because if it was me, you woulda been dead, man; we’re trained to kill.”

I find the second officer’s comments even more disturbing! He says, “If it woulda been me, you’d be dead! We are trained to kill!” This is indicative of the attitude of Cleveland’s finest!

Now a week later, the man shot in the chest filed a federal lawsuit against the Cleveland PD. In response, the city has stated the reasons the shooting was justified. There’s only one problem. In the city’s one assertion of what went on, they contradicted the second part of what they said was another reason for the shooting! YOU’RE NOT FOOLING ANYONE, CLEVELAND PD!

Beware this officer, Cleveland!

    Shot and not charged with trying to take the officer’s gun? Looks like the city of Cleveland is going to be paying for this one.

    In a fair and just world, the cop would go down for ADW at least. But as usual, the City and cops will say nothing was done wrong, while paying out a couple of million dollars. LOL, as an accounting decision.

    ROTFLMAO -it was a routine traffic incident, nothing unsafe, everyone was behaving themselves – until a state functionary poked a gun through a innocent American’s car window and fired point blank into the innocent & unarmed & quiet American’s chest.

    There are two sides to every story. I read some of the officers comments that refuted the plaintives comments and vice versa. I guess we will have to see what comes of the trial. It should be interesting.

    There are quite a few places that do have civilian review boards. I think that should be the standard, as long as the civilian review board was properly trained in criminal law and the department’s SOPs. They should also be kept independent of the police department so there’s no chance of them being coerced into a decision. For felonies, I think that a grand jury, which is already in place, is appropriate. Just my two cents.

    Not a bad take. I prefer, however, making police academies longer. Instead of a 26 week, give or take 2, course. Lets make it an associates degree between 18-24 months and have 6 months dedicated to constitutional and state laws.

    Problem is that it should be the officer who pays for it. Again, a cop shoots someone out of uncontrolled fear.

    And this cop will be allowed to repeat his mistake.

    Professional experience, clean records. AND TEETH. There was a citizen review board that recently had most members resign because the sheriff simply ignored it.

    The very least a CRB should be capable of is filing charges independantly of the local PD and DA.
    They should be capable of ending the job of a cop who can’t be trusted to make sound decisions. It is for sure his friends won’t.

    Education and training can not replace character and judgement issues.

    Requiring such can weed out the worst, but it only goes so far.

    Lake Placid is a comedy/horror movie about a plus 30 foot saltwater Croc in a Maine lake and just one long. relentless dialog of jibes and sarcasm. In the scene I was referencing, the Sheriff offers a pork chop as good luck to a professor about to scuba dive into the lake. The professor replies something like “only if you chew the bark off my big log”. The Sheriff looks quizzically at a paleontologist in the boat and asks “was that a homosexual remark?”.

    Nothing more.

    Driving reckless, hanging out the sunroof, illegal turns,etc. will warrant a pull-over, then perhaps they will find other mischievous things the person has done, so they could clean-up some crime
