Noblesville, IN Chalking Case of #MACtour UPDATE #1

For a little over a month Brain and I have been stalled out in Southern Ohio awaiting justice from a Noblesville, IN court system. Quickly, for those just learning of this utterly ridiculous case, we each face a count of “criminal mischief” for using chalk (yes, some liquid chalk too – OH NO!!) on the sidewalk outside the Noblesville Police department back in September; see this video.

In the video above Brian gives an update on the current status of our case. There isn’t really anything too pressing to update you on at this time. This is the stage of the ‘justice system’ where you wait and wait, and wait. While we’ve spent time filing motions for evidence/discovery, to join our cases and dismiss our charges the rest has been spent waiting to hear from the court or playing phone tag with the prosecutors. Neither has produced much success at this point.

You’d think that the ‘state’ would be jumping at the chance to close the books on our case by either taking our proposed deal or counter offering another. Yet, they remain silent and distant. All that will change next Tuesday – December 8th – when Brian and I head back to Noblesville again for our final pretrial conference. There’s a chalking event that is being held before our court case but it should be noted that this date will either be short, or rescheduled.

Yet, we’re hoping that it will be settled and that we can get back to MAC and the #MACtour. If you’d like to help make that possible consider calling either prosecutor listed below.
