Denied right to file emergency restraining and custody order
Sad to say but the male has to fight upstream just to get joint custody in the current family court system. Stories such as this about restraining orders are all too common, as are the stories of childhood bullies becoming thugs with guns and badges. The only advice I can give you is to hire the best family law attorney you possibly can.
Do bring a friend (or 5) with cameras. Cellphone cameras work great. File complaints. See if you can get Internal Affairs to listen to you.
Me and my daughters mother have had a rough relationship. She has been making threats to disapear with my daughter for over a year now. On friday June 22 we were having a moment and she sent me an email stating “you’ll never see your daughter again”.
Taking that threat serious and having physical evidence I decided to visit the Police department to find out what my options were the very next morning. I originally asked for a detective figuring they know alot about the law and would be able to help me but got a patrolman instead. After showing the officer some threatening texts and the email from her the officer stated there was nothing I could do except for go to court Monday and file for custody. I then went home and started filling out the Parenting petition online so that I would be prepared for court on Monday morning.
Around 4pm I was served with an emergency restraining order from the merrimack nh pd where I reside. Confused I immediately called the derry pd to confront them on why they never mentioned that option when I was there earlier in the day. The officer talked in circles and wouldn’t give me a strait answer but stated I still had a right to file even tho she filed on me. I then went to the merrimack pd and was told by 2 officers that I couldn’t “cross file” and that they were refusing to let me file the paper.
He also tried to change the subject alot and tried intimidating me by saying he remembers me as a kid and all we had history. I went home and called back the derry police to ask if he actually had the right to deny me the right to file the form and the LT told me that he in fact did not and that I could file a complaint. I informed him that I would be filing a complaint on both police departments and asked if everything was documented from my earlier visit which he stated was.
I also plan to file a complaint with the FBI. I need copblocks help somehow I have no camera and feel very unsafe filing complaints against the police but I’ve had it with getting lied to and denied rights when my ex just because shes a girl says a couple things and has police at my door. The guys not always the bad guy I trully care about my daughters safety and well being and believe my daughters mother is unstable and possibly suicidal and I was taken for a joke and lied to by 2 police departments.
I’m writing this because I am having bad anxiety because my daughter could be in Florida for all I know and I have to break the law if I want to find out where she is. Now if she is really going to run away with my daughter she has a 2 day head start thanks to Merrimack finest. I pray nothing happens to my daughter but if something does I know I will be holding both police departments responsible. If there is anything cop-block can help me with I would appreciate it. Im %100 behind you guys and your cause. I have been mistreated my whole life by the system but that for another day. Thank you guys keep up the good work hope this wasn’t just another rant for you guys.
