75 Year Old Grandmother Held Down at Gunpoint on Bathroom Floor by Wayne County, NY Sheriff’s deputies and Macedon, NY Police as they Shoot and Kill her Dog.

On August 15, 2012, Wayne County, New York Sheriff’s deputies, along with Macedon, NY Police broke into 75 year old Phyllis Loquasto’s Plank Road home in the town of Walworth, NY, forced her at gunpoint to lay on her bathroom floor, screamed at her to stay down, then executed her dog “Duke”.

Minutes earlier, Loquasto, who has had three strokes and a knee replacement, was on her computer when she heard loud smashing sounds, then saw what she described as several men dressed in black with masks on.

Loquasto said the men pushed her into the bathroom and told her to lay down and close her eyes.

As she was laying on her bathroom floor Loquasto could hear the men talking in loud voices. “The dog hadn’t even barked, yet I heard one of them say, he’s aggressive, shoot him! I’ll never forget the sound of that gunshot and the blood flying everywhere. They did all this while forcing me to lay on the bathroom floor, screaming at me to stay down, and holding me at gunpoint. I couldn’t get up if I wanted to. I’m 75 years old, had three strokes and knee replacement, and can hardly walk.  There was nothing I could do to help my pet.”

Unfortunately, Duke died a slow death. “They shot him with a shotgun in such a manner that he ran around in pain and bled all over the house and suffered a slow, cruel death.  There was no reason for this kind of treatment, they killed my dog for no reason. This was the sweetest and most gentle animal anyone could want, I would trust him with a baby.”

As you can see in the photo, Duke did indeed suffer, bleeding out throughout the house, leaving a trail of blood in the hallways, stairs, walls and bedrooms, including on the bed where he used to sleep in.

Afterwards, Phyllis Loquasto was taken outside and placed inside a police car for over an hour in the heat.

It was then when officers showed her a search warrant, and it was then that Loquasto realized who these masked men who had just broke into her home, held her at gunpoint, screamed at her and executed her dog were — police officers.

The 75 year old Loquasto was so afraid, she urinated on herself.

As a filmmaker, writer and activist exposing police misconduct and corruption, hearing stories of police officers abusing and violating innocent citizens’ rights is nothing new.

In fact I receive an average of 20-25 calls weekly from people who either themselves, or a loved one, has been abused, harassed, or assaulted by law enforcement.

But I must admit, to hear of a 75 year old lady having been terrorized in her own home by a bunch of rogue, thugs in uniforms and masks, in a “home invasion-like” style, before executing her dog, left me speechless.

I Called Macedon, NY police and asked to speak to a public information officer. The woman who answered the phone asked me “What’s that?” I explained to her it’s usually a department official who is in charge of communicating with the press.

She replied “We don’t have that.”

I then proceeded to tell her about the incident with Duke, and before I could finish, she angrily cut me off and said “I’m sure if a grandmother would have been held down at gunpoint, I would have heard about that.”

She then abruptly transferred me to the Chief, with whom I left a message on his voicemail.

About an hour later, I received a call from Macedon, NY Police Chief John P. Colella.

After I thanked him for getting back to me, Chief Colella laughed and said “The media campaign continues.”

I asked Chief Colella what he meant by that comment, but he completely ignored my question.

I then asked the Chief exactly what law enforcement agencies were present at the Plank Road residence.

Chief Colella said that a search warrant was executed by the Wayne County Narcotics Enforcement Team (WayneNET) on the residence.

He also said that he is the Task Force Commander.

Chief Colella told me that his task force seized several marijuana plants from the location, which he said belonged to Phyllis Loquasto’s grandson.

He explained that the WayneNET team consists of the Wayne County, NY Sheriff’s office, Macedon, NY Police, Clyde, NY Police, Lyons, NY Police, Newark, NY, Palmyra, NY Police, Sodus Point, NY Police, Wolcott, NY Police and the Wayne County, NY District Attorney’s office.

Chief Colella confirmed that the only person inside the location was 75 year old Phyllis Loquasto.

Having sensed an obvious sense of sarcasm on the Chief’s part, with his earlier comment, about the “media campaign continues”, as well as what I would describe as the non-chalant, hesitant, and “careful” tone of his voice, not giving many details, I decided to get down to brass tax with the Chief.

I asked him about police officers holding down a 75 year old grandmother at gunpoint on her bathroom floor, and it was clear that Chief Colella wasn’t comfortable answering my question.

But perhaps more interesting, he never denied officers doing this to Loquasto.

Instead, Chief Colella made sure to choose his words very carefully, stating that all he would say is that she (the grandmother) was “held in place” by officers.

Again, when I asked Chief Colella if in fact officers with his WayneNET task force held a 75 year old grandmother at gunpoint on her bathroom floor, Chief Colella replied “I don’t care if she is 2 years old or 75 years old.”

I think Chief Colella must have realized that his statement would not look good, so he decided to do some ‘damage control’ by quickly adding “We needed to secure the location and since there was a dangerous animal, we were holding her down for her own safety.”

Dangerous animal?

Duke was her pet.

After a few more minutes of talking with Chief Colella, it became more and more clear that as is common with law enforcement officials, especially in cases of misconduct and abuse, the “cover-up” was already in effect, and he clearly had his story which he has every intention of sticking to.

Im sure U would feel the same had this incident happened to you or your family. Do you know what its like to just have a family pet come up missing, no less being shot in your home and hearing it running around bleeding to death, scared and hurting? Nobody to put it out of its misery? Im sure there are pets out there that will protect their owners, but I do believe that this was not the case and if it was there are other ways to subdue the pet as Im sure you know. This was tragic and uncalled for!

    “Town Attorney Ivan Legler said he referred the lawsuit to the Arizona Municipal Risk Retention Pool, which in turn has appointed Larry Crown and associates at Jennings, Haug & Cunningham of Phoenix to represent the town and the officers.

    Legler noted the Yavapai County Attorney’s Office declined to file charges against the police officers in Smith’s death.

    The shooting occurred after Smith came at three officers with a knife during a domestic violence call April 17 in the 5200 block of Stetson Drive. The officers answered the call at 3:57 p.m. from Meloche, who said her husband grabbed her by the hair, pulled her to the floor, threatened her with a taser and told her he was going to kill her, police Administrative Sgt. Brandon Bonney said at the time.

    Smith, who taught an alcohol awareness class, reportedly drank beer and was intoxicated before the incident.

    The confrontation escalated to Smith charging at the officers with a knife after they entered his house, according to an investigation that the Arizona Department of Public Safety conducted.

    The lawsuit states Smith “snapped” after he and Meloche argued, and details an account leading to the shooting.

    “Smitty had never before been physically violent with her during their arguments,” it states.

    The lawsuit criticizes the police’s handling of Smitty.

    “There were no exigent circumstances for officers to rush into the home,” it states. “Yet that is exactly what they did.”

    Moral, don’t rush towards 3 cops armed with a knife.

I cannot comment on this completely, but we do know that he is adapt at hiding his digitial whereabouts but we do know he resides in Lower Manhattan. We have been asked by several organizations to attempt to locate him as he has secretly accessed several computer servers and that alone is a federal offense.     This comments section reminds me of third grade recess. Maybe some of those posting are younger than you think?

    I can’t vouch for the veracity of most of the stories, but I don’t see this as an “anti-cop blog at all”. It IS pointing out cops who cross the line and become criminals themselves, operating under color of authority. Any decent cop would, I think, approve of it. I worked ambulance for over a decade, some of that in some big cities, and cops who pulled crap like this were detested by the ones who actually tried to do their jobs right. The cops I knew were proud of never having had to draw their guns in a long career. They would never have drawn their guns on a dog just because it was barking. ANY dog will bark at a stranger who’d forced their way into a home. As for their treatment of the old woman, that was absolutely beyond the pale. This one call should have gotten them fired AND jailed.

    Since the deliberate militarization of L.E. all over the country, thugs are being hired more and more often. They’re about one step up on the violence scale from the idiots TSA hires – the wannabes who are too scared to try to be actual cops. The police in America have been and are being turned into a cross between a standing army – exactly like what the Founders warned us about – and a street gang. THAT is what needs to be addressed. Castle laws should be reinstated everywhere – and would be if this was still a “free country”. Creatures like these don’t realize what they’re doing to the country by indulging their enjoyment of bullying, and they wouldn’t care if someone told them. They’re America’s Brownshirts, they’re the kind who would have become S.S.

    I see this resolving in one of two ways. If the takeover isn’t stopped and a recovery begun, they’ll just continue to get worse, torturing pets and children before they kill. If America DOES finally wake up and the complicit authorities don’t do the jobs they’re supposed to and continue to rely on being backed up by other complicit entities in the government, we’re going to start seeing some gruesome decorations hanging from tree limbs and lamp posts, a la “Strange Fruit”. Even the most trampled and drugged up, brainwashed people have a limit somewhere, and this is exactly the kind of behavior that will find it soonest.

    enslave keene – I do apologize for my overreaction. It was a default statement and it appears the story is not making news with reputable media outlets (e.g., Fox News, ABC or local affiliates).

    In my opinion, although I do feel horrible for this elderly lady (if the story is authenticated), the story probably is not important to the local media because I’m sure (stories are out there) this has happened more that once in various cities.

    I’m not a fear monger and It’s my strong belief that NOT all cops are bad! The focus on police officers (compared to bad cashiers) is because a police officer (and it has happened) can lie about evidence and therefore a person’s freedom is compromised due to a rogue cop.

    Ron, if there were good cops, they would police their own ranks and the bad ones wouldn’t get away with this kind of shit.

    The same bunch of brave heroes who protected and served Shannon Allen’s grandmother and young son came to my house a year later, minus Ken Morley. While several of them held 2 very scary preschoolers at bay outside by threatening them with assault weapons, the rest were inside watching in admiration as their fearless leader Charles Winn stuck his handgun in the face of a 1-year-old child.

    They don’t just “condone putting a gun” to a child’s head, they do it ALL THE TIME. The children are merely one more weapon they use to demoralize and terrify the parents. The lasting effect on the kids? The long-term cost to society? Who cares? Certainly not the police.

    It would be great to actually have a few police officers assigned to talk about these issues in an honest, open way. If they’ve been assigned to be disruptive, than I think would be egregiously pathetic and risky, because it would pretty easy to discover them considering how much @CommonSense has posted his abusive retorts on here.

    And I doubt it. I know there ARE police officers monitoring this website, but most of them I think are doing it out curiosity and just to keep an eye on what is the latest that’s being posted. But I don’t think there’s any real effort to be disruptive and I really doubt that @CommonSense is a cop.

    I think he’s just frustrated chump.

    “Common sense” isnt asking for a news source, I am. All I want is to hear, watch or read from 1, uno, single source about this case other than a biased reporter or one with an agenda. Something along the lines of factual who, what, where, when… The why is what is left to opinion.

    I have scoured the web looking for this source and can not find it? Why is that? Until I do, I have no good reason to believe this even went down. There has got to be more integrity to this than a facebook page or an independent film maker who has an axe to grind.

    It’s no different than trying to get an accurate “skinny” on the American health care system from someone like Michael Moore, there is just no credibility.

    For the 5th time on this blog does anyone or can anyone please provide some verifiable content to the charges? PLEASE?

    Honestly, I do not think the story will make the headlines because this type of behaviors seem to be accepted as the norm by overzealous cops.

    We dont know these things because there is not 1 story in the news to verify any of this. There is absolutely no evidence (as of yet) this even happened.

    This is very poor journalism. If I had turned something like this into my high school newspaper I would probably receive a suspension for liable.

    Lets start with the headline…”75 Year Old Grandmother Held Down at Gunpoint on Bathroom Floor by Wayne County, NY Sheriff’s deputies and Macedon, NY Police as they Shoot and Kill her Dog.”

    Okay? So what then? Some cops just arbitrarily chose some elderly woman and bumrushed her house? Cmon! The article itself is absent of any predicates relating to the subject matter. There are no footnotes or biblios.. Aside from a facebook page from the victim.

    At one point the author refers to a grainy photo of a staircase and wants the reader to believe a dog suffered a horrible death.

    How do I know that isnt red wine stains or a spaghetti sauce? Any photos of the dog? Did the police restrain this woman while they “cleaned up” the joint? If so then why not replace the carpet 1st. I mean this is a police cover up right? Spare no expense!!

    The assumptive dialouge in this article is like something out of the “Onion” news. Am I the only one thats sees this?

    Ron, postal workers don’t have any authority to police their own ranks. Cops do. And they don’t. For every one who shoots, beats, Taser’s, chokes, intimidates, rapes and robs, there are dozens, hundreds, who fail to intervene and refuse to testify. Therefore, I stand by my assertion that there aren’t any good cops.

    What I can say to any of you skeptics (legit, and unfortunately the evil/crazy/obsessed-with-CopBlock ones like “Common Sense”), is taking this story at its face value or not (and it IS real), for some of us, until we have it happen personally, we wouldn’t believe any of it about cops either. But I speak as someone who HAS had it happen and bullied and even followed into my JOB, and most importantly my CHILD PUT IN DANGER by the very ones sworn to protect her and our beloved dog euthanized (nice word for murder)for going after someone he felt threatened my child, and lost jobs from a stalker calling and making remarks about me, and falsey prosecuted and lied about by police because I’m standing up to them (finally), is that IT’S OVER as they knew it. We on all sides, all backgrounds, all races, everyone, are finding out the truth and we are shocked (or were) and SICKENED!!!! It’s over. The masses are waking up.
